Conveyancing is the legal work involved in buying or selling property.
A conveyancer is a qualified lawyer who is either a Solicitor, a Legal Executive, or a Licensed Conveyancer.
The process of conveyancing involves carrying out searches, checking the legal title to the property, raising or answering pre-contract enquiries, dealing with any mortgage conditions, drafting or approving the contract for the sale or purchase, drafting or approving the Transfer Deed, approving and completing any mortgage Deed, exchanging contracts and completing the sale or purchase, redeeming any existing mortgage, and registering your purchase and mortgage with the Land Registry.

The requirement for a Home Information Pack has been suspended by the Government as from 21 May 2010, and the Government propose a permanent abolition.
This means that sellers no longer have to pay for searches to be performed on their property at the time of placing their property on the market. However, an Energy Performance Certificate will still be required. This involves an inspection of your property by a qualified Energy Inspector who will then prepare a report. Prices vary depending on the size of your home and the area in which you live, but the cost of a report is typically between £60 and £100. If you have not already arranged a report we would be happy to arrange this for you when taking your instructions to act for you on your sale.
At Camp Conveyancing we understand that in modern life many more people own property jointly whether they are spouses, civil partners, co-habitees, friends or relatives.
You may wish to ensure that the property goes to your joint owner if one of you dies, or you may wish to ensure that your share in the property can be left to others in your Will; you may wish to protect your investment in the property and share the remaining equity; you may have invested money but your joint owner will pay the mortgage- whatever agreement you have reached you need expert advice to ensure that your wishes and intentions are put into effect.
You can discuss your requirements with us in confidence and we can advise you as to which type of ownership is most suitable for you, and whether this can be included in the transfer deed, or whether you would benefit from having a more detailed Declaration of Trust.
If you are not married or in a civil partnership then you may also wish to consider having a Relationship Agreement drawn up to record your agreement as to ownership, not just of your home, but also with regard to other assets, and to any arrangements you may have agreed in the event that you wish to separate. Whilst no-one likes to think about it all going wrong, having a Relationship Agreement can ease the pain of a separation by setting out what each party will keep if the worst happens.
